2. Acceptance of these Terms
By accessing, browsing or using this website, you confirm that you have read, understood and agree to these Terms of Use. If you do not agree, please do not use the website.
If you use the website on behalf of an organisation, you represent that you are authorised to accept these Terms on that organisation’s behalf.
3. Scope and relationship to other agreements
These Terms govern use of the public website and related public online materials. They do not replace:
- customer master services agreements, service level agreements or statements of work;
- hardware, fitment, maintenance or recovery contracts;
- White Label or Reseller partner agreements; or
- platform, app or portal terms that apply when you log into iLocate, iFleet, iReports or the Cellstop mobile applications.
Where a signed commercial agreement conflicts with these website Terms in relation to paid services, the commercial agreement prevails for that service relationship.
4. Acceptable use
You may use the website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site. You must not:
- attempt to gain unauthorised access to our systems, accounts, networks or data;
- interfere with or disrupt the website, servers or networks;
- use automated scraping, harvesting or similar tools in a way that overloads or misuses the site without our prior written consent;
- introduce malware, harmful code or deceptive content;
- misrepresent your identity or affiliation when submitting enquiries; or
- use the website to commit fraud or any other unlawful activity.
We may suspend or restrict access where we reasonably believe these Terms have been breached or where necessary to protect the site, our users or our business.
5. Enquiries and communications
Website enquiry, proposal, White Label and Reseller forms are provided so you can contact Cellstop. Submitting a form does not create a binding supply contract. Quotes, proposals and service commitments arise only when confirmed in writing under our normal commercial process.
You are responsible for ensuring that information you submit is accurate and that you are authorised to provide it (including personal information relating to other people where applicable).
6. Platform and app access
Access to iLocate, iFleet, iReports, mobile apps and related customer systems is provided under separate credentials and agreements. You must keep login credentials confidential and notify us promptly of suspected unauthorised use. We may suspend accounts to protect security or comply with law.
7. Intellectual property
Unless otherwise stated, the website content, branding, logos, text, graphics, layout and software are owned by Cellstop, CIL or our licensors and are protected by intellectual property laws. You may view and print pages for your personal or internal business information purposes only.
You may not copy, modify, distribute, republish, commercially exploit or create derivative works from website content without our prior written consent, except as permitted by mandatory law.
“Cellstop” and related marks are used under licence from Cellstop International (CIL) where applicable. Nothing in these Terms grants you any right to use Cellstop or CIL trade marks without written permission.
8. Disclaimer
Website content is provided for general information about Cellstop products, services and programmes. It may be updated from time to time and may not reflect the latest configuration, pricing, coverage or technical capability for your use case.
To the fullest extent permitted by South African law (including the Consumer Protection Act 68 of 2008 where it applies), the website is provided on an “as is” and “as available” basis. We do not warrant that the site will be uninterrupted, error-free or free of harmful components.
9. Limitation of liability
To the fullest extent permitted by law, Cellstop and its directors, employees and agents are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data, goodwill or business opportunity, arising from your use of or inability to use the website.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under South African law.
Liability for contracted tracking, fleet or partner services is governed by the applicable customer or partner agreement, not solely by these website Terms.
10. Third-party links and embeds
The website may link to third-party sites or embed third-party content (for example app stores, maps or partner resources). We are not responsible for third-party content, availability or privacy practices. Accessing third-party resources is at your own risk and subject to those parties’ terms.
11. Privacy and cookies
Personal information submitted through the website is handled as described in our Privacy Policy. Cookie use is described in our Cookie Policy. Our approach to PoPIA and GDPR is summarised on the PoPI Act and GDPR Compliance page.
12. Changes to these Terms
We may update these Terms of Use from time to time. The “Last updated” date at the top of this page indicates when this version took effect. Continued use of the website after changes are published constitutes acceptance of the updated Terms, except where mandatory law requires a different process.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Subject to any mandatory consumer rights, courts of South Africa have jurisdiction over disputes arising from these Terms or use of the website.
If any provision is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of our right to do so later.
14. Contact
For questions about these Terms, contact us at sales@cellstop.org or using the details in section 1.
These Terms are provided for transparency and operational compliance. They do not constitute legal advice. For advice on your circumstances, consult your attorney.
